Yesterday at 8:00PM, President Barack Obama announced a set of new executive actions to provide relief from deportation for large groups of people currently in the United States without legal immigration status.

Specifically, the President has announced that the Deferred Action for Childhood Arrivals (“DACA”) program will be expanded to include all immigrants who entered the United States before the age of sixteen and who have been present in the United States since January 1, 2010. Applicants will need to prove they do not have any felony convictions or serious misdemeanors on their record, and no more than two minor misdemeanors. Applicants also need to prove they have graduated from an accredited high school, have obtained a GED, or that they are currently working on their diploma or GED. Eligible applicants will receive a protection from deportation by the Department of Homeland Security (“DHS”) and a three-year work permit (instead of the two-year work permit provided under the 2012 DACA program), which may be renewed. Additionally, the President has announced a new program tentatively titled Deferred Action for Parents (“DAP”), which will provide the same benefits as the expanded DACA program (protection from deportation and renewable three-year work permits) to all applicants who are parents of United States citizen or Lawful Permanent Resident children and who have been present in the United States since at least January 1, 2010. Applicants would also need to meet the criminal background check requirements. However, DAP applicants will not have the same education requirements.
