Alteration Of Strata Building Or Strata Lot
The term "alterations" is used to cover the construction, alteration or extension of a structure on any lot by the lot owner new buildings.Alteration to buildings can be mentioned on strata plan in schemes registered before 1st Jan 1998 or re-subdivision in schemes registered after that date .According to strata title act it is not necessary to shown the building on the strata plans but these changes may result difficulties in wrong unit entitlements and other problems.
More often Owners are need approval to alter their strata lot. It can range from setting up lights to opening the attic in order to create another room. The conventional bylaws of the Strata title Act need the Owner to acquire the written authorization starting the alteration. Not all alterations but some require the permission of the Strata Corporation.
An owner must glance to the bylaws to know what alterations need approval before they can be undertaken. Under the standard bylaws of the Strata title Act an owner must get permission before altering the structure or exterior of the building, and things on or attached to the exterior of the building ...
... such as doors or windows and stairs or balconies. Approval need to be obtained to alter patio or deck inclusions. The next issue for the Strata Council to consider is whether the owner should be liable for the future repair and maintenance related to the alteration. Every Strata Corporation must consider revising the standard bylaws regarding alterations to ensure that the bylaw reflects the particular requirements and concerns of the owner.
The standard alteration like construction or extension on a lot has to be approved by other lot owner or the strata company by a decision without dispute at a general meeting. In a two lot scheme a lot owner who wants to do alteration on their lot must give an application to the other lot owner and in large scheme contains more than 10 lots need to give an application to the strata company .
The application must contain the following details:
• The open space or plot ratio requirements of the local authority which apply to the strata scheme as a whole and the particular lot
• If carrying out the alterations will exceed those requirements, the percentage and area by which these will be exceeded.
• If carrying out the alterations will not exceed those requirements, a statement to that effect.
• The location and dimensions of the structure when it is completed in relation to any existing structure on the lot or to the boundary of the lot.
• Any contravention of any by-law which is likely to occur as a result of carrying out the alterations. and if the lot is not a vacant lot
• The materials to be used in the alterations.
• The colors of the structure which will be visible from outside the lot.
• The method of construction of the alterations and the work plan or schedule for Carrying out the alterations.
• Any likely interruption or interference with any easement of support or for services automatically granted under the Act.
