Unfair dismissal, as the name suggests, is a situation where the contract of an employee has been terminated wrongfully. A dismissal can be termed unfair if it has occurred due to the following conditions. Firstly the employer cannot terminate the contract based on race, religion, nationality, sex or even age. An employee cannot be dismissed simply because he/she has filed a discrimination suit. The concept of retaliation is illegal in many countries.
