Perhaps this can be an uncomfortable topic so with out having to ask, here are a few words of advice if you are puzzling over just how much property/cash you might inherit. Every estate will not be the same so its difficult to put time limits on when you should anticipate to know what you may be inheriting from the estate and just how much it may be, the information set out below is to offer you a guide to inform you where within the process you would be expecting to receive this information, nonetheless you should always note that it could still differ depending on the difficulty of the estate in question.
When a Will has been written:
The Last Will & Testament documented by Will Writers will tell you if there have been any bequests or sums of money left to individuals as well as how much this will amount to, to illustrate:
I leave the sum of £12,000 Twelve thousand pounds to WWF
You should be able to ...
... get a copy of the part of the Will that concerns you from the executor. Never the less, should this not be possible you could get a copy of the grant of probate along with the Will annexed after probates granted. This is because the Will becomes a public document after Grant of Probate. If you're a residuary beneficiary you might only find out how much you are due to inherit when the administration period ends. When all the assets have been distributed and all recompense and debts have been paid.
When no will has been written:
With no Will distribution of the estate will be covered under the Rules of Intestacy. This means if the deceased died leaving a spouse or civil partner and children, the spouse will then receive the 1st £250,000.00 as well as life interest in half of the remaining capital. The children will receive half of the remaining capital absolutely.
When the deceased leaves a spouse or civil partner and there are no children, the spouse receives the first £450,000.00 as well as half of the remainder of the capital. The parent(s) of the deceased will then be entitled to the remaining half of the capital. Should there be no parents, it will then pass to siblings of whole blood.
But, if no spouse/civil partner or children exist, the estate would then be distributed in equal parts to any of those who are next in line to inherit the deceaseds estate under the Rule of Intestacy.
However, if the deceased did make a will but is found not to be legally valid, maybe because they did not seek the employment of Will Writers or a Will Writing Service the rules of intestacy will make the decision of how any estate will be given out, and not what is written in the Will. Please be aware its prudent to employ Will writers or a Will writing service when you make a Will.
The net amount of the estate wont be clearly apparent until the deceaseds assets are disposed of, all debts are paid and reimbursements made. The family tree must also be traced to make sure all those entitled will benefit.
To sum up, Wills & Probate can take time, so if you find yourself in this position, you must try to be patient whilst waiting for the outcome.
