Men Succeed In Personal Injury Compensation Claims

Two men who were left with serious injuries as a result of a micro-light crash have been successful in their personal injury compensation claims.

In December 2007, paramedic Jon Ker was flying with Jim Martin when the tailplane of their aircraft suddenly detached, causing the micro-light to crash to the ground. Mr Martin, who was an experienced commercial pilot for the Great North Air Ambulance, was able to guide the aircraft towards a copse at Burgham Park Golf Course, where it crashed into trees.

Both men survived the impact, but they were left with very severe physical damage.

In a new development, a high court judge has ruled that the aircraft's manufacturer was liable for the incident and the two individuals have been awarded payouts.

Mr Ker, who is 42 years old, suffered fractures to both his legs and also sustained a brain injury. He had to go through months of rehabilitation and has been unable to fulfil his dream of becoming a commercial pilot due to the damage he sustained.

Meanwhile, Mr Martin suffered head and facial injuries, as well as fractures to his skull, pelvis, both legs ...
... and left arm. He also needed intensive rehabilitation and now has restricted mobility, permanent scarring and memory impairment.

Commenting on the success of their compensation claims, Mr Kerr remarked: "It's a real relief that the judge found Dyn' Areo liable. This hasn't been about the money but about proving that the accident wasn't our fault. We did everything correctly that day yet because the lugs were faulty we ended up suffering serious injury.

"We could have died. It was only Jim's skill which saved us."

Meanwhile, Mr Martin noted that the last five years have been a "mental and physical battle" for both of them. However, he added that they have not let it stop them from living their lives.
