Know When To Hire Barrister Services
First of all, it is somewhat important to know the difference between a barrister and a solicitor. There are two types of practicing lawyers in England. While a solicitor is mainly known for office and clerical work, the bulk of barrister services are characterised by trial work and advocacy. But, there is considerable overlap in their responsibilities and functions.
Many reasons, though mainly historical, are cited for the presence of two distinct legal professions. But many believe that having trials conducted by experienced and specialist advocates provides a smoother and more professionally run trial. A solicitor can act in place of his client for legal purposes, such as signing a contract and may conduct litigation in behalf of the client. A barrister is prohibited from conducting litigation. While the barrister does speak for the client’s behalf, he can only do so when instructed by a solicitor.
London barrister services cannot traditionally be directly approached by clients (although through direct access this is now possible). They normally have to first approach a solicitor. This has changed since 2004 ...
... and now a barrister can be approached by the public to seek their legal expertise. No longer is a client obliged to be represented by a barrister whom the solicitor has chosen. The public is free to choose the barrister who would champion and defend their cause.
Many times, the fate of a client’s cause is determined not by the solicitor’s vigor, but because of the proficiency and skill of the chosen barrister by the solicitor. Since it is the client’s interest at stake, it would be more reasonable if the client had a say in choosing the barrister to represent him.
Now, a client is free to engage the barrister services of those whom he or she thinks can aptly represent his causes. While all barristers are specialists, it is a good thing to know that you can choose your advocate.
