Australian Business Visa: Monitoring Development

Some holders of Australian business visas may be subject to a three-year monitoring period. The objective of monitoring is to check if the Australian business visa holder is compliant with the visa requirements, to evaluate whether the Business Skills program is meeting its objectives and to report to the government of its performance.
The following subclasses are among those that need to be monitored: 127 Business Owner-Manager, 128 Senior Executive, 129 Business Owner-Manager State/Territory Sponsored, 130 Senior Executive State/Territory Sponsored, 131 Investment Linked, 132 Business Talent, 840 Business Owner-Manager, 841 Senior Executive, 842 Business Owner-Manager State/Territory Sponsored, 843 Senior Executive State/Territory Sponsored and 844 Investment Linked.
During the application, business skills visa holders are asked to sign a declaration that they intend to meet the requirements for their visa. Once they arrive and for the duration of the monitoring period, they will be required to provide certain information. Failure to do so may result in a fine of up to AUD$1,000 or a penalty of AUD$5,000 if convicted ...

If, at any point, during the monitoring period the Department of Immigration and Citizenship find that there are grounds for cancellation of your Australian Business Visa, you will be served a Notice of Intention to Consider Cancellation (NOICC). The Australian Business Visa holder in question can then respond during the given time frame. He or she should provide a reason why the visa should not be cancelled and include any supporting documentation for such. Non-response within the required time would mean the decision will be made based on the information the department has. Extension for the response cannot be granted.
