A Few Things You Must Know About Asbestos Claims
Despite the jeopardy of cancer, many industries still use asbestos as it is one of the cheapest materials that can insulate heat and electricity. The mineral is likely to cause asbestosis, a chronic disease affecting the lungs and leading to lung cancer thus causing the slow death of the victim.
Ever since the first law suit filed against the asbestos manufacturers Turner Brothers after the death of the textile worker Nellie Kershaw in 1924, the number of law suits worldwide filed by the workers suffering from health hazards in the industries manipulating asbestos against such firms has been linearly increasing. According to the Wikipedia, asbestos litigation is the longest, most expensive mass tort in U.S. history, involving more than 6,000 defendants and 600,000 claimants. It is predicted that the total expenditure on asbestos litigation in U.S. alone will total upto 200 billion dollars.
The Health Safety Executive of the British government stated that, ‘At least 3500 people in Britain die each year from asbestos related lung cancer as a result of past exposure to asbestos. Annual numbers of deaths are ...
... predicted to go on rising into the next decade' whereas the report of the Trades Union Congress quotes 5000 deaths per year. The government of Britain has taken rigorous measures to reduce the death toll involving a series of legislations disapproving the usage of the asbestos in commercial buildings and workplaces and now insisting on the removal of the asbestos from workplaces in a safe manner. The import of asbestos is also fragged by the litigations thus reducing the number of victims to a considerable level.
Industrial workers who are victims of asbestosis or any other disease caused by the exposure to asbestos can approach disease solicitors/industrial solicitor who works on ‘No Win No Fee' terms and file law suits against the firms which required them to work in the hazardous conditions that lead to the effect.
As per the conditions of the ‘No Win No Fee' agreement, the victim will be entitled to pay nothing in case if the petition or the litigation fails at the court. However on the success of the litigation, the fee of the solicitor and the court fee are levied on the other party i.e. the firm enabling the victim to be free of fee either way. This works best for the victim to protect himself from imminent danger of the chronic disease. There are several incidents where workers of the firms operating on asbestos have gone to the court and sought compensations.
