This Time, They've Gone Too Far
June 23rd, the Supreme Court crossed the line.
An Associated Press story headline read: "The Supreme Court on Thursday ruled that local governments may seize people's homes and businesses — even against their will — for private economic development." Please read this, because this decision will set a precedent to usurpe your rights as a property owner. In my opinion, this is completely unconstitutional. I urge you to write to all your lawmakers (links provided at the bottom of this page) to express your dismay at this shocking infringement on the American people's rights to own and control their own property. Read the original amendments below, and please write to your legislators about this. A Supreme Court decision should be based on the law, on constitutional rights, and common sense. This one was not.
Amendment IV - Search and seizure. Ratified 12/15/1791.
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or ...
... affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
Amendment XIV - Citizenship rights. Ratified 7/9/1868.
1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive [Deprive: deprive v. 1. To take something away from; divest. 2. To keep from the possession of something] any person of life, liberty, or property, without due process [Property may be taken by the government only for public purposes ] of law; nor deny to any person within its jurisdiction the equal protection of the laws.
It's the old "Frog In The Pot" story again. Never get so comfortable that you give away your birthright. Or your children's birthright. Much of the lawmaking is a direct result of powerful lobbies (Political Action Committees, that, in my opinion, should be outlawed) by wealthy individuals or companies bent on protecting their self-interests with a staff of attornies paid to do the same, or it is the result of panic or fear. A fear-based society will gladly hand over individual rights, for what they perceive as "protection" or a "common good". We need to be careful how we define "common good"- actions on the part of communities wishing to increase their tax coffers does not necessarily indicate a "common good" when individuals are deprived of the right to keep their home, for the ultimate benefit of private business interests.
We should not be a fear-based society. Fear shuts you down, and it will shut this nation down, if allowed to continue to permeate our judicial system. On a societal level, our individual rights are our most prized possession. Let no one take that away from you.
Making lawmakers accountable takes just a little effort on your part:
Being aware of proposed changes in the law and how they will affect people,
Contacting your Mayor, Governor, Senator, Congressman, or President through emails, letters, or phone calls.
You can make a difference, with just those two things. You don't have to be wealthy, privileged, or powerful to make a difference. If not for yourself, do it for your family.
