When undergoing a medical test or during the course of a medical, personal injury is always a possibility which must be avoided at all cost. However how do we define personal injury?
Personal injury occurring from a medical malpractice is often a situation in which an individual was injured or has been left with a considerable damaged as a result of a medical practitioner's breach of his duty of care. When medical malpractice occurs and results in a personal injury, this shows up as grounds for legal action. The matter is handled civilly, which means that generally no criminal charges are brought against the medical practitioner, except in rare cases when the physician's actions rise to the level of so dangerous that they were almost certain to cause complications. Instead, the plaintiff who was injured by the negligent medical practitioner files a personal injury medical malpractice action.
Doctors, nurses, psychiatrists and other members of the medical fraternity are held to a reasonable standard of care. This does not mean that a physician needs to have to sweat it out for every consultation. He does, however, ...
... have to behave with the level of integrity, skill and competence that a reasonable physician of his cadre would exhibit. This is true in terms of diagnosis, treatment and all aspects of care provided by the person or institution concerned. The physician is also required to obtain an informed consent before he provides treatment, which means he must tell the patient about the benefits, risks and alternatives so the patient can make an informed decision and either approve or deny the treatment based on their judgement.
If a doctor or any other medical practitioner breaches his or her duty to obtain informed consent or breaches his or her duty to live up to the reasonable doctor standard by performing less than adequate care, the victim can sue the doctor or medical practitioner. To prove the personal injury medical malpractice case, the plaintiff will have to prove this breach of duty and that he actually suffered or sustained damages. This demands a very qualified attorney.
Proof of personal injury comes in the form of medical evidence and testimony by an expert witness. Often, one or more additional physicians are required to testify in proving a personal injury medical malpractice case. These physicians review the situation and provide data, information and opinion to the court in regards to whether the physician acted reasonably or otherwise.
If you are a victim of personal injury due to clinical negligence, get a good attorney and get a reasonable compensation for your losses.
