It is surely very stressful to evict a tenant from your property, but the event gets more painful once months pass by and the payment of rent is not made by the tenant. If a problem arises with this relationship, like any damage has been done, or tenant has violated the agreement statements, it often becomes necessary to evict him from your property. But the question arises How to evict a tenant without further aggravating the situation or landing into troubles and avoiding mental agony and financial loss.
At first step, landlord has to know that under which conditions and circumstances he is allowed to evict his tenants. If the tenant has not paid the rent, or he has made any serious health or safety problems for others or for property, landlord has a right to evict the tenant there and then. Another cause may be the violation of rental agreement by a tenant. Some easy steps are as followed for eviction of a tenant.
As a first measurement to evicting a tenant, landlord is required to serve a written notice to the tenant for eviction. A last chance is a legal compulsion, necessary to be provided to the tenant, in ...
... most of the countries before a landlord is allowed to attempt a legal course of action against him. This last warning is given as a notice and is kept in record for further reference. Then a notice for quit is sent to the tenant. A time limit specifying the deadline for eviction is also mentioned in this type of the notice.
The two broad categories of way for escaping the eviction is pay or comply. If he has not paid the rent, he is required to pay the rent or quit. And if the tenant has caused any problems he is required to comply or leave the property. One has to provide his tenant a limit of 4 to 6 days before consulting the court of law for further legislation. If the problem still persists, an eviction lawsuit may then be filed against the tenant, after the deadline/time limit, specified in the notice has elapsed. The court summons that tenant for reviewing his point of view. Many tenants opt to leave the property after summon is served to them. And if not so, proper legal action in court is followed leading to the eviction.
