Laws Behind Opening A Preschool In India

Preschools were once considered an unorganised section of education because they were not given much importance. However, over the last two decades, there has been tremendous growth in the preschool sector in India, which can be attributed to dual-income families, well-traveled and educated parents who recognise the importance of early childhood education and the impact quality preschooling with the help of educational videos for preschool has on the minds of toddlers in their overall development. Several studies have shown that preschool is important because it helps to lay the right foundation and better prepare children for primary school. With these two factors in play, many individuals and organisations began preschools, which have grown into networks of preschools across the country - either individual/family owned preschools or organisations that began offering the 'preschool franchise' opportunity.

Because preschools involve young lives, the government has established a number of rules and regulations. Let's start with the most important:

A. State governments have enacted laws such as the "Private School Education Acts," which govern school operations. As a result, before opening a preschool or school, Promoters must understand the State Education Act and play to obtain the necessary registrations.

United Nations Conventions on the Rights of the Child: The Convention on the Rights of the Child (CRC) is a human rights treaty that establishes children's civil, political, economic, social, health, and cultural rights. It entered into force in 1990 and India ratified it in 1992. Because all countries that sign the CRC are required to abide by it, many laws concerning children in India meet the CRC's requirements.

C. India's Right to Education Act (RTE): The RTE was enacted in 2009 and establishes education as a fundamental right for children aged 6 to 14. It establishes responsibilities for the government, teachers, schools, and parents. It also addresses laws governing student-teacher ratios and child punishment. Section 11 of the RTE addresses ECCE by stating that the appropriate government should make arrangements to provide free preschool education to children aged 3 to 6 years. This would prepare them for primary school and ensure their care until the age of six.

National Policy on Early Childhood Care and Education (ECCE): Recognizing that the age range of 0 to 6 years is critical for child development, the government proposed specific regulations for this age group. This resulted in the 2013 National ECCE Policy. It aims to provide children with preschool education and care. It accomplishes this by establishing guidelines for the operation of preschools and daycares.

E. Preschool Policies and Laws: The Early Childhood Care and Education (ECCE) Policy governs preschools. In 2013, the NCPCR issued the following guidelines for preschools across the country:

F. Development of Playschools: In our country, the majority of preschools are privately run. All preschools are required to register with the district's nodal officer. The preschool must apply to the officer for recognition. Parents should be aware of the following points:
- The preschool must have the Recognition Certificate from the Nodal officer
- The nodal certificate needs to be renewed annually.
- The authorities may withdraw this certification at any point if the preschool is found to have used unfair means.

G. The ECCE policy establishes a number of laws.
Let's take a quick look at some of the topics.

1. Staff Laws: According to the ECCE, both teachers and carers play important roles in a child's development.

2. Safety Laws: The safety of young children is especially important, and several regulations are in place to ensure it. Make sure you develop a SOP around these laws and that it is strictly followed.

3. Physical and mental harrassment laws: Children's minds are impressionable at a young age. As an educational institution, it is critical that the child is not physically or mentally abused. The rules and regulations that must be followed are outlined in Section 17 of the Right to Education Act (2009).

4. Health laws: all aspects necessary to ensure the child is raised in a healthy environment must be followed. For example, classrooms should have adequate ventilation and hygiene should be maintained.

5. Curriculum Laws: Read up on the curriculum and teaching methodology laws to ensure you follow all norms.

6. Parent-Teacher Association Formation: It is recommended that every preschool form a Parent-Teacher Association within a month of admissions each year.
