You don't need to pay a visit to Las Vegas for gambling. People who don't profess to be gamblers play the dice each time when they are behind the wheel intoxicated or drunken. This is the case with about 33% Americans who are engaged in a traffic accident some time or the other in their lives. About 39% of automobile deaths are associated with drunken driving. These drunken drivers are in effect playing with human lives, which results in creation of invasive rules which are meant to prevent or deter drunken driving. When there is an accident, there is no gainer - only losers.

The first person to be convicted of drunken driving was a taxi driver named George Smith. He was made to pay 20 shillings as a fine and this event subsequently led to the formulation of legislations on drunken driving in 1910. Early laws required proof of the intoxication, without specifically stating what the type of the intoxication was. The rules of observation to estimate whether a person is intoxicated or not were establishing driving patterns that were impaired or erratic. These were succeeded by field sobriety tests like walking in a straight ...
... line or standing on a single foot for half a minute.

The guilt could be demonstrated by using the tests that were based on the opinion of the police officer regarding possible impairment. The tests were subjective and often inaccurate. The first laws on the basis of the presence of a certain amount of alcohol content in the blood had been introduced in Norway in 1936. The blood alcohol content or BAC test was invented although all of them were not dependable. These tests have now been supplemented with chemical tests. It has been observed that the percentage of alcohol in the blood helps determine guilt levels.

Then there were the check points of sobriety which made the drivers stop without a known cause whatsoever for taking sobriety and breath related tests. Although the action violates the constitution, the Supreme Court deemed the practice as constitutional in 1990. Drivers often receive charges such as murder, man slaughter and homicide. A lot of drunk drivers who have been convicted receive a minimum punishment of suspension of their license and even at times jail sentences for a brief period of time for their first offences, or treatment programs. Be careful with driving under influence as you might be gambling with others' lives.
