When Should You File A Claim For Lemon Law?

Owning a car is a necessity for nearly all Americans. Almost 91% of households in the country own at least one vehicle. Today, cars have become an integral part of our lives. We use them to travel to and from work, school, shopping, vacations, and more.
Therefore, when a car is out for repairs, it affects us in our day-to-day life. If you need to visit the dealer too often for the same problem with a car you bought or leased, you could have a lemon on your hands. Once you are sure that you have been a victim of lemon law fraud, you should consider filing a Lemon Law claim before you are past the deadlines, making a claim impossible.
What Is Lemon Law?
Cars are like any other product sold with a manufacturer's warranty. They come with a promise that the product should give satisfactory services for a certain amount of time. If some problem arises during that period, the manufacturer will repair the product for you.
If the manufacturer cannot fix it after a reasonable amount of tries, then that product is commonly referred to as a "lemon."
Consumers who have been sold "lemons" are entitled ...
... to a refund, replacement vehicle, or cash settlement to be paid by the manufacturer.
Lemon laws were established to protect consumers who have purchased or leased a new or used car or other listed vehicle from a dealership.
For disputes related to lemon law, you can also approach The Better Business Bureau (BBB), which runs an informal dispute resolution program. Many car buyers question, 'is it worth filing a complaint with the BBB Lemon law.' The BBB program works by having a neutral arbitrator review the claims and conclude.
It is worth noting that the arbitrator's decision is binding on the manufacturer but not on the buyer. So, you are free to file a lawsuit if you do not agree with the arbitrator's decision.
What Is The Time Limit For Filing A Lemon Law Complaint?
Every state has its lemon law stipulations. As per Texas Lemon Law, a lemon law complaint has to be filed within six months following the earlier of:
1 – The express warranty term expiry
2 – 24 months after purchase; or
3 – 24,000 miles following the vehicle's delivery date (except TRVs).
The period for filing the complaint is determined by whichever of the above events come earlier. The consumer should file a complaint as soon as they realize that the dealer cannot repair the vehicle despite multiple attempts.
To summarize, every car buyer should learn about lemon laws that govern their state and act early. If you need assistance with lemon law claims, you can contact the lemon law experts at Allen Stewart.
