Rulings Of Miqaat Before Proceeding The Umrah
Miqaat is the place where pilgrims wear Ihram in order to perform Hajj or Umrah. The spot of wearing Ihram is Adni al-Hal which means the first place out of Haram and it is allowable to become Muhrim from one of quintet well-known Miqats but it is better to perform Ihram of Umrah al-Mufradah from one of the quintet Miqats. Therefore it is better for pilgrims who have the purpose of performing Umrah al-Mufradah and has gone to Medina before to become Muhrim from Masjid Al-Sharjah or at least Juhfah. Rulings of Miqaat:
• Wearing Ihram is not permitted before Miqat. As it is Haraam to pass Miqat without Ihram and pilgrims should become Muhrim in Miqat except for two conditions:
1- If the pilgrim executes Nazr to become Muhrim before Miqat then it is essential to undertake his/her Nazr from any place and there is no need to restart Ihram in Miqat, so when a person has distrust about Miqat or its similar place can perform “Nazr of Ihram” before reaching the distrusted place and becomes Muhrim from that place and there is no change between mandatory or Mustahab Hajj; and Nazr of wife has no problem if it doesn’t distract her spouse.
• Reaching Miqat should be verified by inevitability, sureness, and famousness among pilgrims of that place or at least testification of one unbiased pilgrim. And if there is any hesitation then wearing Ihram is not allowable, apart from by performing Nazr.
• Pilgrims who don’t know the place of Miqat cannot become Muhrim based on the appearance of guide or leader of procession who says that place is Miqat except that they have certainty about their expression; also assumption acquired from the expression of informed pilgrims is sufficient. Except they should refer to people of that place.
• Passing Miqat without Ihram is not acceptable unless there is another Miqat on the way that in this case execution Ihram from the second Miqat is accurate, although he/she has done an untrue act.
• It is not allowable to delay Ihram from Miqat intentionally, also it is mandatory safeguard not to pass the similar place to Miqat without Ihram while there is another Miqat after that.
• Pilgrims who go to Mecca to perform Umrah al-Mufradah, they should go to one of the famous Miqats cannot pass Miqat without Ihram and if they do this then it is mandatory to reoccurrence to Miqat and become Muhrim from there and if they cannot return they should become Muhrim from the place that they are.
• If pilgrims pass Miqat without Ihram and there is another Miqat on the way then there is no need to return to first Miqat but he/she becomes Muhrim in the second Miqat.
• When a pilgrim doesn’t become Muhrim in Miqat because of unawareness or vagueness then whenever he/she recalls if he/she is out of Haram then he/she should become Muhrim from that place and if he/she has arrived Haram then should go out of Haram (for example Tan" seem) and wears Ihram and if he/she cannot go out of Haram wears Ihram from the place that he/she is.
• When pilgrim rejects Ihram because of unawareness or forgetfulness and distinguishes the matter after completing the acts then his/her acts are correct.
• A pilgrim who arrives Mecca with Ihram of Umrah al-Tamatu’ it is allowable for him/her to deliberate it as Umrah al-Tamatu’ if it is the months of Hajj (Shawwal, Dhu’l-Qa’dah and Dhu’l-Hijjah) and perform Hajj al-Tamatu’ following that.
• When a woman pilgrim is in her menstruation period and thinks that she is not allowable to wear Ihram and doesn’t wear Ihram in Miqat she should reappearance to Miqat if she can and become Muhrim. And if she cannot then she should go out of Haram and wear Ihram in there. And if she cannot either then wears Ihram in place that she is and her Umrah is correct.
