Accidents are unfortunate incidents that come as a bolt from the blue and shatter the lives of people. Victims suffering personal injuries can only feel the agony and pain. Apart from the physical pain, the individual sufferer is put through severe financial strain and mental stress. Along with the victim other members of the family also suffer. Death of a person/persons due to accidents puts the family of the victim(s) in a crisis. Other than being a shocking incident, all of a sudden circumstances change compelling the family members to compromise with their lifestyle leading to a decline in their standard of living.

Now, to get back to their normal life and living style at the earliest, victims of injuries or death due to accidents need money. Filing injury claim often helps the injured person to overcome the financial difficulty. The victim has two options to settle the injury claim. Either litigation or out of court settlement.

Litigation is the due judicial process and the courts after verifying all the evidences pertaining to the incident and evaluating the injury claim may pass an order in favor of the ...
... victim, and ask the opposite party to pay the compensation. Out of court settlement is a compromise arrived at without a court hearing and the opponent party is asked to pay the victim a negotiated amount as compensation to the victim.

It is quite confusing for a victim to decide one-way or the other. Therefore it is necessary to have clarity of both the processes. In this respect advice of experienced personal injury lawyers is of immense help and they can suggest the best option suitable for the particular case. To have a clear insight, it is better to study the pros and cons of both the processes.

Out of court settlement: Normally, the defendant's insurance company pays the compensation for the injury claim, and getting them into the settlement process is easier. To avoid the time consuming, expensive litigation process in a court, insurance companies prefer out of court settlement.

Out of court settlements of injury claim are faster and fulfill the immediate need of finance for the injured person. This helps in the recovery process and relieves the mental stress of the victim to a great extent. But the flip side of this settlement process is that the compensation amount is low covering the exact medical expenses and nothing more. This process does not compensate job loss or other damages like permanent disability, loss of earning during hospitalization, damage to property, etc.

Litigation: A time consuming process and requires completion of lots of formalities. Has to be planned properly and handled professionally by competent injury claim lawyers to get compensation.

The compensation awarded by civil courts is satisfactory, because the court takes into account job loss, declining lifestyle, physical and mental pain, medical expenses, physical disability and damage to car and property.

However, the bottom line is that the victim has to decide which is the best option considering his position. Since there is a variation in degree of damage and pain in different accident cases and injury claim, for low amounts out of court settlement is better. For higher compensation claim, place the matter before the court.
