Spousal Sponsorship To Canada    By: john smith
People immigrate for a large number of reasons. The chief among them is the assurance of a secure financial future for themselves and their families. Financial security would imply improved standards of living as well as the best educational facilities for their children. There are a lot of people immigrating to Canada especially expatriates working in Gulf countries. The main reason for this is the security and safety that the Canadian government offers its people. The social help system in Canada is also highly developed and helps people to find jobs faster as well as it supports them when they lose jobs. They are also very supportive of people who need vocational retraining. The Canadian government also supports spousal sponsorship so that the whole family can live together. Conditions for Spousal Sponsorship Spousal sponsorship is only allowed by Canadian citizens or permanent residents of Canada. However conditions apply to be eligible to be sponsored. The spouse or the partner should have been in a relationship for at least 2 years or less and have no children in common with the partner/spouse. Moreover once they receive their permanent resident status, it is mandatory for them to live with their spouse or partner for a minimum of 2 years. This new clause was introduced to prevent abuse of women and a large number of cases of marriage fraud. The new rules became applicable only from October 25, 2012. Exceptions are allowed only in cases where the sponsor dies or the sponsored spouse suffers abuse from the sponsor or his relative. Qualifications Of A Sponsor A person becomes eligible for spouse immigration only after he obtains citizenship or permanent resident status. He can then sponsor close relations like his spouse or partner, dependent children or siblings, parents or grandparents. The sponsor must prove that he has the financial means to provide the sponsored relatives with all the essential needs including food, shelter, clothing, and other basic necessities. Healthcare not provided by public health services must also be covered by the sponsor. If the sponsor does not meet the financial criteria, the application is normally refused except if the sponsored person is the spouse or dependent child. The length of the whole application process varies from one visa office to another. For applications to be processed outside Canada, the applications are submitted in Mississauga, Ontario while those are that processed in Canada are submitted to a center in Vegreville, Alberta. Requisites Of An Invitation Letter A person who wishes to visit Canada must receive an invitation to visit Canada from your sponsor. This letter although necessary does not guarantee that the visa will be issued. Visas are issued only if the applicant meets with the requirements laid out in the Immigration and Refugee Protection Act. The letter must contain information about the person being invited including his name, date of birth, address and contact number, reasons for the trip, duration of stay, and of course their relationship with the invited person. The sponsor must also give relevant information about himself again including name, date of birth, address and contact number, occupation, citizenship status, and other relevant information as required(read entire article)(posted on: 2012-11-22)

Canadian Sponsorship Visa Is In Great Demand    By: john smith
A lot of people migrate to Canada because Canada's GDP is among the highest in the world. People believe that migrating to Canada assures them of a basic standard of living and better prospects for themselves and their family. The healthcare provided is irrespective of income level. All aspects of healthcare except dental care are covered by the government. The Canadian government also assures its citizens of unemployment insurance, senior pension, and family allowance. The college tuition for its citizens is also extremely low. Another reason why people seek sponsorship visa to Canada is because of the diversity of its population and therefore greater level of tolerance among its peoples. How Is An Immigration Appeal Filed? Immigration appeal is required when your application for immigration to Canada has been denied. This appeal has to be filed before the deadline and therefore it is important to contact your immigration lawyer as soon as you receive the notification. The lawyer will then file your appeal before the Immigration Adjudication Division or the Federal Court of Canada. The lawyer will scrutinize your immigration application to find out whether it is a Canadian sponsorship application, skilled worker application, or a Work Visa that was refused. When an immigration officer reviews your application, he goes through the guideline found in the Immigration Manuals and Immigration regulations to see if you meet all the criteria. Only then is your application processed further. When Is An Immigration Appeal Required? Immigration applications are not usually rejected on the whims of an officer, however, it is possible that the guidelines have been interpreted too strictly or perhaps some of the documentation submitted was not fully scrutinized. There are even times when the applicant fails to impress the immigration officer during the personal interview. Your application could even be refused because you did not comply with all the requirements of IRPA. Other reasons could be if you have violated human rights or is perceived to be a security threat in some way. If it has been proved that you have not been wholly truthful in your submissions, you could be refused. There are three types of immigration appeal namely spousal appeal, residency appeal, and criminality appeal. The Significance Of Deportation Appeal When your immigration appeal is rejected, you could be served with a departure order, exclusion order, or deportation order. A deportation order is usually issued by the Immigration and Refugee Board of Canada or the Canada Border Services Agency and will permanently bar you from Canada. Deportation orders are usually given when you commit criminal acts and is considered a threat to national security. If you provide false documentation or overstay in the county after the expiration of the visa, you could be deported. Deportation appeal is made to the Removals Officer at the Removal Unit of the Canada Border Services Agency to delay your removal for medical reasons, for your children to complete the school year, and so on. If this is refused then your appeal is sent to the Federal Court. If it is rejected in the Federal Court, you will of course have to leave the country(read entire article)(posted on: 2012-11-22)
